1 Terms

1.1 When you purchase Goods and/or Services from us you agree to be bound by both these online terms and conditions and by the Minute Mediation Ltd terms and conditions which are emailed to you as part of your confirmation of booking. Where there is inconsistency between the Minute Mediation website’s terms and conditions and the online terms and conditions of this Website, the online terms and conditions of this Website will prevail.

1.2 The online terms and conditions do not affect your statutory rights as a consumer.

1.3 Minute Mediation Ltd may vary the online terms and conditions at any time. Your continued use of the Website following any variation to the online terms and conditions shall be deemed to be acceptance of any variation.

1.4 If you do not accept these terms and conditions in full, you must leave this Website immediately. These terms and conditions shall apply every time your buy Goods or Services from the Minute Mediation Ltd.

2 The contract

2.1 Your order constitutes an offer to Minute Mediation Ltd to buy Goods and/or Services. All orders are subject to acceptance by Minute Mediation and such acceptance will be by way of email confirming payment needs to be made for the Goods and/or Services (the purchase confirmation). The contract between you and Minute Mediation Ltd will only be formed when you are sent the purchase confirmation.

2.2 The contract will relate only to those Goods and/or Services which have been confirmed in the purchase confirmation.

3 Disclaimer

Whilst the Minute Mediation Ltd make every effort to maintain the accuracy of the information on this Website, it disclaims any warranty or representation, expressed or implied, about accuracy, completeness or appropriateness for a particular purpose.

4 Fraud

4.1 Minute Mediation Ltd reserves the right to take legal action against committing or attempting to commit online fraud.

5 Price and payment

5.1 Prices and any additional related charges (where applicable) are as published in the confirmation of sale which is emailed following every order.

5.2 Where Value Added Tax (VAT) is chargeable, this will be added and displayed separately at the checkout, and on the order summary and receipt at the current prevailing rate. This rate may vary from time to time.

5.3 Payment for Goods and/or Services is accepted through major credit and/or debit cards excluding American Express, Diners and other corporate business cards. Your card will be charged directly after your order has been placed but the time taken to process the payment through your account will be dependent on your card supplier.

5.4 Minute Mediation Ltd accepts no liability if a payment is refused or declined by the credit or debit card supplier for any reason.

5.5 Minute Mediation accepts no liability for any loss or damage, arising directly or indirectly, as a result of a payment being refused or declined.

5.6 If you are purchasing from outside the United Kingdom you will be charged in your own currency and the banks will perform the currency conversion into pounds sterling.

5.7 Confirmation of your payment will be displayed on screen once it has been authorised and accepted. You will also receive confirmation of the transaction to the email address you have provided.

5.8 We reserve the right to refuse to process payments.

5.9 We may at our sole discretion do such checks as we may deem fit before processing a credit or debit card payment from the user, for security reasons. As part of such checks, we may disclose personal data to third parties for the purpose of carrying out these security checks. In the event that we are not satisfied with the credibility of the User, we will have the right to reject the payment.

5.10 We will not be liable for any damages resulting from our decision not to process a payment made through our Online Payments facility.

6 Data protection policy.

6.1 Minute Mediation Ltd does not hold customer credit or debit card details on its Website or any of its data systems. All credit or debit card details are managed by Minute Mediation Ltd’s payment service provider Stripe, who is compliant with the payment industry’s highest standards for data protection and transaction security.

6.2 Any personal data collated through Minute Mediation will be treated confidentially and will only be used to process your order and for statistical analysis to continually improve the Website and its Services to you, and to service the Website. Personal data will be processed in compliance with the principles of the Data Protection Act 1998.

6.3 Data may be shared with the police, the government or any other legal authority investigating suspected legal activities if there is an official request.

7 Indemnity

7.1 As a customer you agree to indemnify Minute Mediation Ltd against all claims, damages and expenses arising out of any breach of these online terms and conditions and other liabilities arising out of your use of Minute Mediation Ltd’s Website.

8 The entire agreement

8.1 These online terms and conditions and any document expressly referred to in them, represent the entire agreement between you and Minute Mediation Ltd in relation to the subject matter of any contract. 9 Limitation of liability

9.1 Minute Mediation Ltd will not be liable in contract, tort, or pre-contract representations (excluding fraudulent or negligent misrepresentations) or otherwise, for any economic losses, loss of goodwill or reputation, or special indirect losses incurred by you or any third party arising out of or in connection with these online terms and conditions.

9.2 These online terms and conditions do not exclude or limit the Minute Mediation Ltd’s liability for death or personal injury arising through its negligence.

9.3 Minute Mediation Ltd will not be held responsible for any delay or failure to comply with its obligations under these online terms and conditions if the delay or failure arises from any cause which is beyond its reasonable control.

10 Law

10.1 These online terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and if any disputes arise in connection with this agreement, the parties will attempt to settle it by mediation in accordance with the CEDR Model Mediation Procedure and the mediation will start, unless otherwise agreed by the parties within 28 days of issuing a notice to mediate to the other.

11.1 If there is an occasion where an issue has not been resolved to your satisfaction you may wish to contact a member of the management team regarding your complaint.
